What is the HITECH Act?

The HITECH Act allocates $19 billion to healthcare IT efforts, and includes incentives for physicians who make “Meaningful Use” of Electronic Health Records (EHR) beginning in 2011.

What is “Meaningful Use”?

EHR software that is:

• Certified, and has electronic prescribing capabilities
• Connected for electronic exchange of Protected Health Information (PHI)
• Capable of generating clinical reports

What payments are available to qualifying physicians through Medicare?

Beginning in 2011, physicians become eligible for incentives from Medicare so long as they demonstrate “Meaningful Use” as described above. Providers using certified EHR software by 2011 will see a total of $44,000, while providers who wait until 2014 will be eligible for only $24,000. After 2015, incentive payments will end.

Are there penalties for NOT adopting an EHR by 2015?

Yes. Medicare payments may be reduced to 99% in 2015, and reduced further to 97% by 2017 for practices that have not implemented a certified EHR.
